If you want to sell food that you make at home, you need to prepare the food in a completely separate, commercial kitchen that is registered as a food premises.

It is illegal to prepare and make food for sale in your existing domestic kitchen.

Changes to home based businesses

When the Food Act 2014 takes effect from 1 March 2016, a wide range of food sectors will be able to use domestic kitchens.

In the period to 1 March 2016, businesses that fall within the scope of the Food Control Plan (FCP) Food Service and Catering will be able to use domestic kitchens under the Voluntary Implementation Programme (VIP).

Businesses will also need to meet any other legal requirements such as home based area district plans, bylaws and other relevant acts and regulations.
